Welcome to davidjosue.com (the “Site”), operated by David Josué Delgado Salazar, doing business as David Josué Photography (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you may not use the Site.

These Terms cover use of the Site only. Photography services offered through the Site are subject to a separate Photography Services Agreement signed by the client and David Josué Photography at the time of booking. Course access and digital products purchased through the Site are subject to additional terms presented at the point of purchase.

1. Agreement to terms

By accessing or using davidjosue.com, you represent that you are at least 18 years old, you have read and understood these Terms, and you agree to be bound by them. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Services

David Josué Photography provides wedding, elopement, boudoir, and portrait photography services primarily in Valle de Guadalupe, Los Cabos, Mexico City, and worldwide destinations. The Site serves as a portfolio, informational resource, blog, store, and point of contact for prospective and existing clients. Booking, contracting, payment terms, deliverables, image rights, cancellation, and reschedule policies for photography services are defined in a separate Photography Services Agreement signed at the time of booking — not in these Terms.

3. Intellectual property — Site content

All content on the Site — including but not limited to text, blog posts, location guides, design elements, layouts, code, graphics, logos, marks, and the davidjosue.com domain — is the property of David Josué Delgado Salazar or its licensors and is protected by Mexican copyright law (Ley Federal del Derecho de Autor), United States copyright law, and applicable international copyright treaties.

You may not reproduce, distribute, modify, transmit, display, perform, license, or create derivative works of any Site content without prior written permission from David Josué Photography. Brief quotation with attribution and a link back to the Site is permitted under fair use / fair dealing principles where applicable, but does not extend to images.

4. Image rights — portfolio and gallery protection

All photographs displayed on the Site — including those in the portfolio, blog posts, location guides, About page, social proof galleries, and any other section — are the personal copyright of David Josué Delgado Salazar. These photographs are NOT in the public domain, NOT royalty-free, NOT licensed under Creative Commons, and NOT available for use under any “fair use” or “fair dealing” interpretation absent express written permission.

The following uses of any photograph on the Site are strictly prohibited without prior written permission from David Josué Photography:

This prohibition applies to all visitors, automated systems, web crawlers, scrapers, AI training data collectors, and any third party accessing the Site by any means.

Permission for any use of any image must be obtained in advance and in writing from David Josué Photography at dj+legal@davidjosue.com. Permission for one image or one use does not extend to other images or uses. Verbal permission is not effective.

Violations may result in DMCA takedown action (see Section 11 below), monetary damages claims, and legal action under Mexican copyright law, United States copyright law, the European Union Copyright Directive (where applicable), and any other applicable law.

11. DMCA notice and takedown

davidjosue.com complies with the United States Digital Millennium Copyright Act (DMCA) and operates a takedown procedure for copyright complaints under 17 U.S.C. § 512. We have designated an agent to receive notifications of claimed copyright infringement.

Filing a DMCA notice

If you believe that any content on the Site infringes your copyright, you may submit a written notice to our Designated Copyright Agent that includes all of the following, as required by 17 U.S.C. § 512(c)(3):

  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including the URL on the Site where the material is located

Upon receipt of a complete and valid DMCA notice, we will investigate and, if appropriate, remove or disable access to the allegedly infringing material and notify the user who posted it.

Counter-notification

If you believe content you posted was removed in error, you may submit a counter-notification to the Designated Copyright Agent containing the elements required by 17 U.S.C. § 512(g)(3). We may restore the content if no court action is filed within the statutory window.

Repeat infringer policy

It is our policy to terminate, in appropriate circumstances, the access of users who are determined to be repeat infringers.

Misrepresentation

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages.

To the fullest extent permitted by applicable law, David Josué Photography, David Josué Delgado Salazar, and any related party shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Site, even if advised of the possibility of such damages. Our aggregate liability for any claim arising from or related to the Site is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred United States dollars (USD $100). This limitation does not apply where prohibited by applicable law.

You agree to indemnify, defend, and hold harmless David Josué Photography and David Josué Delgado Salazar from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising out of or related to your violation of these Terms, your misuse of the Site, your violation of any third party’s rights, or your violation of any applicable law.

15. Governing law and dispute resolution

These Terms are governed by the laws of Mexico, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms or your use of the Site shall be resolved in the competent courts of Ensenada, Baja California, Mexico, and you consent to the personal jurisdiction of those courts.

For visitors who are residents of jurisdictions where local consumer protection law grants non-waivable rights to bring claims in their home courts, those rights are preserved.

16. Changes to these terms

We may modify these Terms at any time. When we do, we will update the “Last updated” date at the top of this page. For material changes, we will provide notice via a prominent notice on the Site. Your continued use of the Site after the effective date of any change constitutes your acceptance of the updated Terms.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.

18. Entire agreement

These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and David Josué Photography concerning your use of the Site, and supersede any prior agreements or understandings. They do not, however, modify the separate Photography Services Agreement that governs photography services booked with us.
